Alors que j'ai encore la tête dans ma kasbah en terre battue au milieu d'une palmeraie marocaine, alors que j'ai les pupilles des yeux usés par les la magique et majesteuse vallée du Dadès, alors que j'ai des tajines, briouates, des cornes de gazelles et autres douceurs marocaines plein les bourrelets, alors que mon bronzage pèle et son tatouage au hennée aussi (oui je sais, j'ai des vrais pbs à gérer !!!), alors que j'ai une 20aine de gigas de photos fabuleuses à trier, l'actualité de l'adoption indienne me ramène brutalement vers ce blog !
Car en Inde, un petit poutch est en cours de préparation !
Les poutchistes ? Quelques RIPA (sudistes à priori) qui ont intenté une action auprès de la Supreme Court, accusant la CARA, l'autorité centrale indienne en matière d'adoption, d'être corrompue et inefficace ! La leader du mouvement est Nomita Chandy, directrice du prestigieux RIPA Ashraya à Bangalore. Forte de son récent prestigieux prix "shree padma" (genre prix nobel de la paix national indien) qu'elle a obtenu en mars 2011, elle fait partie des rares RIPA à pouvoir la ramener et affronter la CARA ainsi. Et puis elle fait partie des "grosses têtes" de l'adoption indienne depuis des années, elle n'a jamais mâché ses mots dans la presse (souvenez vous, lorsque j'étais passée au jt de tf1, elle avait été interviewée). Ca a été repris par pas mal de journaux indiens (il faut se féliciter de cette large médiatisation !), et malheureusement certains journalistes en profitent pour tirer abusivement sur l'adoption internationale...

“Total apathy and corruption of the respondents (ministry and CARA) has led to the adoption process being reduced to a farce, and empowering opaque state-run children’s homes and criminal private individuals to play with the lives of adoptable children and adopting parents, very often reducing the solemn process of adoption to a commercial transaction involving little babies,” stated the petition argued by senior advocate K K Venugopal."
"The petition also alleged that the central government has not maintained any record of the adoptable children in the country. According to the petition the central government has failed to direct the various state governments to register all Child Welfare Institutions as per the provisions of the Juvenile Justice Act, 2000.
The petition also pointed out to the fact that states in India does not have any official figures of the number of abandoned and relinquished children, which could ensures that when a minor is missing, sold, trafficked or even killed, there would be some record of the child’s existence."
"Adoption statistics from the Cara website show a decline in legal adoptions in the past decade, though the demand for babies has only grown, the NGOs pointed out to bolster their claim that the agency wasn’t functioning properly. Cara also has not finalised adoption guidelines that have been in “draft” form since 2006.
The NGOs have also accused the government of discriminating between private-run bodies, which provide primary care to such children, and state-run shishu grihas as far as grant and renewal of licences are concerned.
While Cara has been indifferent to the functioning of shishu grihas despite repeated complaints of corruption and high mortality rates, allegedly arising out of apathy and gross negligence, private-run organisations and institutions working in the area are subjected to strict, and often meaningless, controls, the PIL said.
Citing another instance of the alleged bias, the NGOs said an inordinate number of abandoned children sent to private agencies by child welfare committees — government panels in districts that decide the fate of homeless children — are disabled, while the shishu grihas “choose” kids who will be placed in their care.
Cara itself has often not filled up the vacancies of its chairperson and secretary on time and failed to file mandatory information reports on several occasions with the Registrar of Societies, the NGOs have said. "
* appoint an independent body of agency representatives, child-care experts, psychologists, physicians, lawyers, sociologists and planners to review the entire adoption regime in India
* study the functioning of CARA and the procedural hindrances plaguing the adoption of abandoned children
* ask CARA to furnish data on the number of homeless, abandoned and relinquished children along with a status report of how many were lodged in governmental and non-governmental homes."
Quelles seront les conséquences de tout ceci ? Je n'en sais strictement rien. Dans le meilleur des cas il y aura un audit de la CARA qui pourrait conduire à une restructuration du système si la campagne dans la presse est violente ? Oui mais quand....
En tout cas, cette action en justice ne semble pas contester les nouveaux guidelines (alors que la rumeur disait depuis qqs semaines qu'elle devait attaquer les guidelines histoire qu'ils ne puissent pas être mise en application d'ici qqs jours comme prévu) ce qui est une grande déception. Plus rien ne pourra arrêter ces guidelines, quel dommage.
Et c'est un sérieux avertissement envoyé à la CARA par les RIPA, suite aux réunions qui ont eu lieu il y a qqs semaines et aux propos tenus par la CARA...
En tout cas moi, je félicite chaudement Nomita et les autres RIPA pour leur courage et pour voir mis un bon coup de pied dans la fourmillière de la CARA. Le nouveau chairperson de la CARA ne va pas chômer (lui!), et j'aimerais bien connaître l'ambiance autour des tchaï de la CARA en ce moment...
